Recurring payments will be processed automatically monthly on the same date as your first payment. Late Fee: If rent is not received within 5 days of the due date, a $50 fee applies plus 10% per day thereafter.

Rental Agreement Terms & Conditions

Please read each section carefully. You must acknowledge each section before signing.

Section 1: Use and Compliance

The Premises shall be used solely for the storage of personal property owned exclusively by the Occupant. Occupant shall not store property of others or any item subject to a lien without written notice to Owner as required under RCW 19.150.010. No living, sleeping, business, manufacturing, mechanical, or other commercial activities are permitted. Occupant shall comply with all local, state, and federal laws, ordinances, fire codes, and environmental regulations.

Prohibited items include but are not limited to: gasoline, diesel, propane, solvents, explosives, fireworks, paint, batteries, chemicals labeled “Danger,” “Poison,” “Toxic,” “Flammable,” or “Corrosive,” ammunition, perishable foods, or any material which emits odor, attracts pests, or presents a fire or environmental hazard.

Owner reserves the right to immediately remove or dispose of prohibited items at Occupant’s expense and to terminate this Agreement without refund if violations occur.

Acknowledgment *

I understand this space is for storage only. No living, sleeping, or business activities are permitted. I will not store prohibited items including fuels, propane, explosives, chemicals, ammunition, or perishable foods.

Section 2: Term and Rent

This Agreement creates a month-to-month tenancy commencing on the move-in date. Rent is due monthly on the same date as the initial payment and will be automatically charged to the payment method on file. Late or failed payment shall constitute default.

Owner may adjust rent or fees by providing Occupant thirty (30) days’ prior written notice. Non-payment of rent, utilities, or other charges for more than six (6) consecutive days authorizes Owner to deny access, per RCW 19.150.030. Partial payments do not waive default or Owner’s lien rights.

Acknowledgment *

I understand that rent is due monthly and will be automatically charged to my payment method on file on the same date as my initial payment. Either party must provide 30 days' written notice to terminate this agreement. Failure to provide proper notice will result in forfeiture of my deposit. Prepaid rents are non-refundable.

Section 3: Insurance and Risk of Loss

All property is stored at Occupant’s sole risk. Owner does not insure Occupant’s property and assumes no duty of safekeeping or security.

Occupant shall maintain, at Occupant’s sole expense, insurance covering the full replacement value of all stored property against fire, theft, vandalism, rodent or insect damage, water, wind, collision, and acts of nature. Failure to obtain such insurance constitutes Occupant’s election to be self-insured and fully assume all risks of loss.

Occupant expressly waives and releases any claim against Owner for loss or damage, including those caused by Owner’s active or passive negligence, and agrees that any insurer shall waive all rights of subrogation against Owner.

I understand that OffGrid RV & Boat Storage does NOT insure my property and assumes no duty of safekeeping. I will maintain my own insurance or accept full risk of loss as a self-insurer.

Vessel License Hours

Section 4: Damage, Loss, and Indemnity

Occupant shall be liable for any and all damage to the Premises, fencing, gates, utilities, paving, landscaping, signage, cameras, or other improvements caused by Occupant, Occupant’s guests, invitees, agents, or contractors. Occupant shall reimburse Owner for repair or replacement costs immediately upon demand.

Owner shall not be liable for, and Occupant hereby releases, indemnifies, defends, and holds harmless Owner, its members, managers, employees, agents, and affiliates from any and all losses, damages, injuries, claims, suits, judgments, penalties, or expenses (including attorney’s fees) arising out of or related to: (a) Any act, omission, or negligence of Occupant or Occupant’s guests; (b) The storage, presence, or condition of Occupant’s property on the Premises; (c) Theft, vandalism, fire, explosion, collision, storm, wind, falling branches, flood, rodents, insects, mold, mildew, or any other act of nature or third party; (d) Bodily injury or death to any person occurring on or about the Premises, except to the extent caused solely by Owner’s willful misconduct.

This indemnification shall survive termination or expiration of this Agreement.

Plain-English summary: The Tenant is financially responsible for any damage or claim connected to their use of the facility and agrees not to hold OffGrid responsible for accidents, acts of nature, or loss.

Acknowledgment *

I agree to hold harmless and indemnify OffGrid RV & Boat Storage from any losses, damages, injuries, or claims arising from my use of the facility, including theft, vandalism, weather events, or acts of nature.

Section 5: Limitation of Liability

Owner and its agents shall not be liable for any indirect, consequential, or punitive damages under any theory of liability, including negligence. Occupant acknowledges that Owner does not guarantee security or surveillance and that any devices (locks, cameras, lighting, or gates) are for Owner’s convenience only and create no duty or warranty.

Occupant waives all rights to jury trial and agrees that damages, if proven, shall be limited to the lesser of (a) $5,000 or (b) the monthly rent paid for the space.

I acknowledge that any damages recoverable are limited to the lesser of $5,000 or one month's rent, and I waive my right to a jury trial.

Section 6: Owner's Lien and Default (RCW 19.150)

Owner holds a statutory lien on all property stored at the facility for unpaid rent and charges. If default continues for fourteen (14) days, Owner may deny access, place its own lock on the space, and sell or dispose of property as permitted by RCW 19.150.060. Notice shall be sent to the last known address and any alternate contact provided.

Property valued under $300 may be disposed of without sale per RCW 19.150.090. Sale proceeds shall be applied to Occupant’s debt; any balance will be held or remitted as required by law.

If rent remains unpaid for sixty (60) days or more, Owner may have any vehicle, watercraft, trailer, recreational vehicle, or camper towed or removed from the facility in lieu of sale, pursuant to RCW 19.150.160. Prior to towing or removal, Owner will provide written notice to Occupant identifying the towing company’s name, address, and contact information. Owner shall not be liable for any damage to the property once it is in the possession of a licensed third-party towing company.

Acknowledgment *

I understand that under Washington law (RCW 19.150), Owner holds a lien on my stored property for unpaid rent and may deny access, sell property, or have my vehicle/boat towed if I fail to pay.

Section 7: Right to Enter

Owner, its agents, or government officials may enter the Premises with three (3) days’ prior written notice for inspection, maintenance, or compliance purposes. In cases of emergency, suspected abandonment, or default, Owner may enter without notice to protect property or enforce this Agreement. Entry for such purposes shall not constitute trespass or violation of Occupant’s privacy rights.

Acknowledgment *

I understand Owner may enter with 3 days' notice for inspection or maintenance, and without notice in emergencies, suspected abandonment, or payment default.

Section 8: Termination

Either party may terminate this Agreement by providing thirty (30) days’ written notice prior to the next rental period. Upon termination, Occupant shall: (a) Remove all property and debris; (b) Leave the space broom-clean and undamaged; and (c) Return all keys and access devices.

Any property remaining after termination is deemed abandoned and may be sold or disposed of pursuant to RCW 19.150. Failure to give proper notice or vacate on time shall result in additional months’ rent.

I understand I must provide 30 days' written notice to terminate, remove all property and debris, and return all keys and access devices.

Section 9: No Warranties or Bailment

Owner provides storage space only and does not take custody, control, or possession of property. No bailment, deposit, or warehouse relationship exists. Occupant acknowledges that the Premises are suitable for intended use and that Owner makes no express or implied warranties, including security, fitness for purpose, or habitability.

Section 10: Rules and Regulations

Occupant shall comply with all written or posted rules governing access, safety, and cleanliness. Owner may modify such rules with reasonable notice. Violation of facility rules constitutes default and may result in immediate termination or denial of access.

Facility rules include: (a) No person may live in any stored vehicle or boat at any time; (b) No repairs or maintenance activities in storage areas; (c) Nothing may be stored outside of the assigned space; (d) No hazardous materials (e.g., gas cans, batteries, chemicals, paint, fuel, oil) may be stored; (e) Tarps must be factory covers only (no blue tarps); (f) A spotter is required when backing vehicles into spaces; (g) Gates must be locked upon exit; (h) An OffGrid representative must be present during vehicle movement; (i) No cameras or recording devices (including dash cams, trail cams, and security cameras) may be mounted on, placed in, or operated from stored property while it is at the facility.

I agree to comply with all facility rules including: no living in vehicles, no repairs on-site, nothing stored outside my space, no hazardous materials, factory covers only (no blue tarps), spotter required when backing in, gates must be locked upon exit, and no cameras or recording devices on my stored property.

Section 11: Notices and Miscellaneous

Notices shall be delivered personally, by first-class mail, or by verified email (if consented). Notices by mail are deemed delivered five (5) days after mailing. Occupant must notify Owner in writing of any address, phone, or email change within ten (10) days.

Time is of the essence in this Agreement. This Agreement, including incorporated rules and RCW 19.150, represents the entire agreement between the parties. No oral promises or representations are binding unless stated in writing and signed by both parties. Washington law governs this Agreement. If any provision is deemed invalid, the remainder remains enforceable.

I understand notices are deemed delivered 5 days after mailing. I must notify OffGrid within 10 days of any address, phone, or email change. Washington State law governs this agreement.

Section 12: Access Hours

Access to the facility is permitted BY APPOINTMENT ONLY between the hours designated by management, unless otherwise approved. Occupant is required to contact OffGrid via email or text message to arrange access appointments in advance.
